How high can I build up around chimney pot?

I am self building an extension to our existing loft over the rear addition of our property. On the party wall I will be building along is a chimney stack with pots on top. Planning has been passed which approves the new roof height to come up the chimney pots, but I wanted to know if there are any regulations regarding how high up a pot you can brick? I have been advised that I can brick up around the pots in situ, but want to know if there is a clearance at the top of the pot that needs to be kept. The building is 1900s Victorian London terrace with clay pots. I want to make sure I can build up enough to have appropriate waterproofing onto flat roof.
